Obtaining a residence permit in Kazakhstan for a citizen of Uzbekistan

One of our clients contacted us to obtain a residence permit in Kazakhstan for a citizen of Uzbekistan. A citizen of Uzbekistan is an employee of the company and is planning a long-term stay in the territory of the Republic of Kazakhstan. The employer and the foreign employee doubted whether to do it on their own or to involve immigration lawyers.

Obtaining a residence permit in Kazakhstan for a citizen of Uzbekistan

After reviewing the data, we did not recommend applying for a residence permit in Kazakhstan for a citizen of Uzbekistan in the near future. The main risk area is the minimum period of work in Kazakhstan on official employment. In addition, the salary was also minimal. There are details that reduce and increase the chances of obtaining a residence permit in Kazakhstan for a citizen of Uzbekistan and other foreign applicants.

The process was resumed 6 months later after following all our recommendations. So, what were the criteria that increased the chance of obtaining a residence permit in Kazakhstan for a citizen of Uzbekistan?

  3. Official employment and obtaining a temporary residence permit in Kazakhstan for a citizen of Uzbekistan. A foreign specialist holds a management position in two companies. The period of work is sufficient. The salary is competitive and marketable. Accordingly, taxes are paid in good amounts.

STAGE 1 – obtaining a work permit to Kazakhstan for a citizen of Uzbekistan.

STAGE 2 – obtaining a temporary residence permit for a citizen of Uzbekistan.

In order to obtain a residence permit in Kazakhstan for a citizen of Uzbekistan, it is necessary to have the status of permanent resident in the Republic of Kazakhstan. For this purpose, it is necessary to obtain a temporary residence permit.  In our case, the foreign specialist had a temporary residence permit. We just extended it for an additional 12 months.

List of required documents:

  • copy of the employment contract
  • copy of the application
  • notarized certified consent for residence, etc.

Result of service provision: obtaining a residence permit.
Terms: 3 working days from the date of registration of the application.

Stage 3 – preparation and execution of documents for obtaining a residence permit for a citizen of Uzbekistan.

After obtaining the temporary residence permit and collecting the full package of documents, we registered the application.

List of required documents:

  • original passport
  • copy of the temporary residence permit
  • application form
  • certificate of no criminal record
  • lease agreement
  • certificate from the bank
  • medical certificates
  • payment of state duty, etc.

Timeline: The coupon was issued on the 10th working days. On the 15th working day, we submitted the application to the bank for additional confirmation of funds. On the 41st day a written reply with a decision was issued.

IMPORTANT POINTS WHEN COLLECTING DOCUMENTS:

  • tracking the expiration dates of certificates and letters
  • there are requirements for bank certificates and a certificate of no criminal record. Any document will not do. We provided templates.

Stage 4 – submission of documents for obtaining a residence permit in Kazakhstan for a citizen of Uzbekistan.

Important! Submission of documents is carried out at the regional Migration Police Department at the registered address of residence. The Migration Police Department has the right to request additional documents. In our case, after checking the documents, they issued a registration coupon for the 7th working day. Together with the document review coupon, the district Migration Police Department issues a request to the bank in two copies to confirm a certificate from the bank confirming the availability of the required amount. These certificates are signed by a citizen of Uzbekistan, one copy is returned to the Migration Police Department, the second copy is handed over to the bank. The bank reviews the request; on average, the review takes 5 business days and issues a response confirming the availability of funds in the foreign citizen’s account. This confirmation must be submitted to the regional Migration Police Department. Review of documents and issuance of permission to obtain a residence permit takes 45 calendar days. The reference date is the date of issue of the coupon.

Stage 5 – after the permit is issued, the next stage is submitting documents to the Public Service Center to receive a certificate. 

Important! At this stage, the presence of the property owner with an ID or passport is required. It is possible to provide the interests of the owner by another person on the basis of a power of attorney. Issuance of the certificate will take 7 working days under an accelerated procedure.

Result: obtaining a residence permit certificate of the Republic of Kazakhstan for a citizen of Uzbekistan.
