Obtaining of business immigrant c5 visa for Italian citizen
A foreign company registered in the UK contacted us with a request to obtain a C5 business immigrant visa for an Italian citizen. There was a need to open a subsidiary organization in Kazakhstan, where the manager was a foreign citizen of Italy.
As it turned out, during the initial registration, obtaining a C5 business immigrant visa for an Italian citizen was not required, since the founder was entirely a foreign legal entity. At the same time, an Italian citizen was appointed as the head and there was a need to be present on the territory of Kazakhstan.
At the initial stage, we issued a C3 work visa by exception for a foreign citizen from Italy. The procedure began immediately after the company was registered. The process of obtaining a C3 work visa for an Italian citizen was subject to an exception, since the founder is a company with 100% foreign participation.
Subsequently, obtaining a C5 business immigrant visa for an Italian citizen was still required, since by agreement of the parties, after a certain time, the foreign employee received a share in the Kazakh organization.
What were the difficulties in obtaining a C5 business immigrant visa for an Italian citizen?
Obtaining a visa at the Kazakhstan embassy abroad. The foreign employee had to leave the Republic of Kazakhstan despite having a C3 category work visa. A single-entry C5 business immigrant visa is initially issued for a period of up to 90 days. A prerequisite is to receive a visa at the Embassy of Kazakhstan abroad.
PROTOCOL: the procedure consisted of several stages.
Stage 1 – Initially, a single-entry C5 business immigrant visa is issued for business immigrants
for a period of up to 90 days. The process consists of two stages:
- Issuing an invitation letter and issuing a visa support number. The process took 7 working days. Documents are provided from the employer. Technical information is required from a foreign specialist. Service delivery time is 5-20 working days. In our case, the visa support number was issued on the 7th working day.
- Inserting a visa at the Embassy of Kazakhstan abroad. After receiving the visa support number, ere is an appeal directly to the embassy to obtain a single-entry C5 business immigrant visa for an Italian citizen.
List of required documents:
- a copy of the invitation letter with the approved visa support number;
- original of passport;
- copy of the passport;
- 1 photo 3.5*4.5;
- completed visa application form;
- confirmation of payment of the state fee;
- medical certificates;
- a certificate of the presence or absence of a criminal record, issued by the authorized body of the country of citizenship with an apostille;
- a certificate confirming the absence of a ban on conducting business activities.
Timeframe: A visa support number is issued within 5-20 working days. In our case, the number was issued on the 5th working day. Sticking a visa at the embassy takes up to five working days from the date of application by the applicant. In our case, after applying, the visa was issued on the second working day.
Risk areas: collection of medical certificates, certificates of no criminal record and a ban on business activities.
Costs: 75 euros for a single-entry visa.
Stage 2. Execution of a purchase and sale agreement for a share in a Kazakh organization
The process takes from 3 to 7 working days after the arrival of a foreign specialist in Kazakhstan on the basis of a C5 visa. A purchase and sale agreement for a legal entity is drawn up in the presence of a notary, seller and buyer. Next comes the registration of the agreement with the authorized body. The process takes on average 3-7 business days.
Stage 3. Multiple-entry C5 business immigrants visa application for an Italian citizen
After the purchase and sale agreement has been completed in the system, we proceed to obtaining a multiple-entry C5 visa.
List of required documents:
- a letter from the authorized body confirming the participation of a foreign citizen in the LLP;
- original passport;
- photo 3.5*4.5 size;
- completed visa application form;
- confirmation of payment of the state fee;
- petition, etc.
Time frame: the procedure will take place in 2 stages. The first stage takes up to 15 working days – receiving a letter from the authorized body. The second stage takes 10 working days – insertion of visa in the authorized body. Sometimes the review process can take up to 30 calendar days.
Risk areas: extension of approval by the authorized body. The original passport is submitted to migration and during this period the foreign employee cannot leave the Republic of Kazakhstan.
Expenses: 30 MCI payment of state duty.
