Obtaining C5 business immigrant visa for a citizen of Russia and Turkey

SITUATION: a foreign citizen contacted us with a non-standard situation. There is a legal entity registered on the territory of the Republic of Kazakhstan. The only participant of the company is a foreign citizen of the Russian Federation. A citizen of the Russian Federation has a second Turkish citizenship. A request was received to re-register the company as a Turkish citizen and, accordingly, to obtain a C5 business immigrant visa for the Turkish citizen. This is the same person, and it was necessary to re-register the company with a different passport.

SOLUTION: in such situations, the re-registration of the company requires obtaining a C5 business immigrant visa of a Turkish citizen. Otherwise, the Department of Justice will not allow registration of the transaction. The primary C5 business immigrant visa is issued in the country of citizenship or in the country of residence, subject to the provision of grounds for long-term stay.

Obtaining C5 business immigrant visa for a citizen of Russia and Turkey

A foreign citizen decided to obtain a visa in Turkey. The client wanted to receive a multiple-entry visa at once, but according to the protocol, the embassy cannot issue an initial multiple-entry C5 visa, and a single-entry visa was received for up to 90 days. To obtain a single-entry C5 business immigrant visa, we have prepared a Letter of Invitation on behalf of an operating company with a request to issue a C5 visa for a Turkish passport.

The procedure took 5 working days from the date of registration of the Letter of Invitation. It took an additional 2 days to prepare the documents. The process went quite fast, as the client responded promptly to our requests and documents were provided in a timely manner.

After receiving the visa support number, the foreign citizen applied to the Embassy of Kazakhstan in Turkey to obtain a C5 visa. In addition to the visa support number, it was necessary to provide additional documents, namely:

  1. Certificate of no criminal record with an apostille mark.
  2. Certificate of absence of a ban on conducting business activities with an apostille mark.
  3. Medical certificates.
  4. Payment of the consular fee.
  5. Completed application form with photo.

The visa pasting procedure at the embassy took 3 working days. Upon arrival in the Republic of Kazakhstan on the basis of a C5 visa, the Turkish citizen submitted a notice of the entrance within three working days. This is a mandatory procedure for all foreign citizens.

The next step was to re-register the company and obtain a multiple-entry C5 business immigrant visa. It took 5 working days to re-register the company for a passport for a Turkish citizen. The package of documents is standard, the procedure takes place both online and offline.

EXTENSION OF RUSSIAN AND TURKISH CITIZEN VISA OF CATEGORY C5 for BUSINESS IMMIGRANTS FOR MULTIPLE ENTRY.

As soon as the company registration was finalized, we began to apply for a multiple-entry C5 business immigrant visa. The procedure consists of two stages:

Stage 1. Receiving a Letter of confirmation from the Akimat (Governor’s Office) by contacting the Department of Entrepreneurship and Investment. The procedure takes up to 15 working days from the date of registration of the written request. In order not to waste time, the request to the Entrepreneurship Department was submitted in advance, while the foreign citizen had not yet entered the Republic of Kazakhstan, and the result was received on the 14th working day.

  1. Certificate of state registration of a legal entity.
  2. A copy of the foreign citizen’s passport.
  3. Business plan.
  4. Power of attorney.
  5. Scanned copy of a single-entry C5 business immigrant visa.
  6. A copy of the identity card of the representative by proxy.
  7. And other documents.

Stage 2. Direct insertion of a visa in the migration of the Republic of Kazakhstan. To do this, it is not necessary to leave the country.  But keep in mind that the original passport will be taken away while the application is being considered. It should also be remembered that you can apply for a visa extension only 30 working days before the expiration of the current single-entry C5 business immigrant visa. The review takes on average 2 weeks. In rare cases, the timeframe may increase to 30 calendar days. In our case, a passport with a multiple-entry C5 business immigrant visa was issued on the 12th working day.
