Obtaining a residence permit in Kazakhstan for a citizen of the Russian Federation

The client applied with a complicated situation. Previously, documents were submitted independently to obtain a residence permit for a citizen of the Russian Federation.

The official response of the authorized body is a negative decision.

Why was I denied?

What is the reason for the refusal? From point of view , there are several reasons:

1. The first alleged reason for refusal is work for an American company that does not have an official registered office in Kazakhstan.
2. The second alleged reason is that the request for a residence permit in Kazakhstan for a Russian citizen was submitted during a period of unstable political situation and at the time of mobilization.
3. Also, having studied previously submitted documents, we found several errors that could affect the decision of the authorized body.

The migration police has the right not to explain the reason for the refusal. In our case, this was the case. The reason for the refusal was not prescribed, but was only referred to paragraph 2 of Article 14 of the Law of the Republic of Kazakhstan “On Migration”.

The client wanted to immediately appeal the decision of the authorized body and resubmit the request. At the same time, the appeal statistics are quite low. We did not recommend doing this and waiting until the permitted date for resubmission of documents.

Important! After receiving a refusal, it is possible to resubmit the request for reconsideration after 12 calendar months.

 What are the risk areas that reduce the chances of obtaining a residence permit in Kazakhstan for Russian citizens and other foreign applicants?

• Administrative offenses on the territory of the Republic of Kazakhstan.
• Country of citizenship where there are military operations and other political instability.
• Inciting interethnic, interfaith and religious hatred.
• Whose actions are aimed at violent change of the constitutional order.
• Those who have married with citizens of the Republic of Kazakhstan, which served as the basis for obtaining a residence permit, in the event that this marriage is declared invalid by a court decision that has entered into legal force and other factors.

What are the criteria that increase the chances of obtaining a residence permit in Kazakhstan for Russian citizens and other foreign applicants?

• Ethnicity.
• Former compatriots.
• The presence of relatives of citizens of the Republic of Kazakhstan or a residence permit.
• The presence of their own operating business in the Republic of Kazakhstan.
• Compliance with the list of in-demand specialties.
• Prolonged period of work in the Republic of Kazakhstan now or previously with official employment and taxation.

Let’s return to the case of obtaining a residence permit in Kazakhstan for a citizen of the Russian Federation who had an initial refusal. There are details in his case that encouraged us, and we decided to resubmit the documents. The applicant’s spouse and child are citizens of the Republic of Kazakhstan.

A Russian citizen only needs to obtain a temporary residence permit to apply for a residence permit and there is no need to obtain a B8 visa.

After a mandatory medical examination, preparation and thorough verification of documents, filling out a questionnaire and paying a state duty of 4 MCI (13,800 tenge in 2023). We visited the district Migration Police Department to check documents. After confirming that the documents are correct, we reapplied for a residence permit in Kazakhstan for a Russian citizen.

Important! During the review period, the applicant may be called for an interview, called and clarified, or requested additional documents.

After 8 working days from the date of registration of the application, we received a coupon confirming the acceptance of documents. After receiving the coupon, we count 45 calendar days during which an official response must be provided.

The positive decision from the authorized body was received on the 42nd calendar day.
