A6 Investor visa is issued to foreign businessmen who have invested over 300 thousand US dollars in the economy of the Republic of Kazakhstan.

How long does it take to obtain an A6 Investor Visa?

The process takes 5 working days from the date of registration of the invitation letter with the authorized body. In rare cases, the review may be extended up to 30 calendar days. It will take additional time to contact the consular office in the country of residence. An important point: there is no interview when applying for an A6 visa. Thus, in the best case, the process may take up to 10 working days, taking into account the prompt submission of documents by the applicant, in the worst case, 25 working days, taking into account the extension of approval.

Does the A6 visa give the right to work?

Yes, the A6 Investor Visa belongs to the category of visas that allow entrepreneurial activity. These visas, also A5 and C5 visas, give the right to work. Thus, an A6 visa gives the right to work in Kazakhstan.

What is the difference between an A6 visa and a C5 visa for business immigrants?

These visas have common features: entrepreneurial activity, the opportunity to be the founder of an LLP (TOO) in the territory of the Republic of Kazakhstan.

At the same time, the C5 is issued only for one year and it is assumed that the foreigner will be the only one or one of the founders of the company in the territory of Kazakhstan. And the A6 visa has broader borders: you can be a founder of a company or invest in the economy of Kazakhstan in other ways.

What are the requirements for a foreign citizen’s passport?

  1. It should not contain additional entries, corrections, erasures, marks, reservations, entries, torn or embroidered pages;
  2. Must have at least 2 blank pages intended for visas, with the exception of recipients of visas for leaving the territory of the Republic of Kazakhstan;
  3. The validity period must expire no earlier than 3 months from the expiration date of the requested visa, with the exception of recipients of visas for leaving the territory of the Republic of Kazakhstan;
  4. It should not be marked with an extension of the validity period.

Can family members get a visa?

Yes, family members and dependents may obtain an accompanying A6 category visa, without the right to work. The validity period and number of entries of the accompanying visa will be identical to those of the principal applicant’s visa. To obtain an accompanying visa, supporting documents must be provided: an apostilled marriage certificate for spouses and an apostilled birth certificate for children under 18 years of age.

Where can foreign citizens obtain an Investor Visa?

  • At consular offices in the applicant’s country of permanent residence
  • Within Kazakhstan, by changing the visa category, provided the applicant currently holds one of the following valid visas: B3 – Business, B9 – In-demand professions, B10 – Private visit, C3 – Work, C4 – Self-employment, C5 – Business immigrant.

  • I am a foreign citizen and have invested more than USD 300,000 in an operating LLP (TOO) in Kazakhstan. However, I did not invest as an individual, but through my company, which is registered abroad. I am the only founder of a foreign company. Can I apply for an A6 investor visa?

Yes, you will be able to apply for an A6 category investor visa if certain conditions are met. It is necessary to provide apostilled / legalized documents confirming the connection between the companies and the applicant. List of documents for legal entities:

  1. An electronic copy of the identity document of the person applying for the investor visa, with a notarized translation into the state or Russian language.
  2. An electronic copy of the charter (articles of association) of the service recipient, with a notarized translation into the state or Russian language.
  3. An electronic copy of a document confirming the position of the person, in accordance with paragraph 3 of these Rules.
  4. Electronic copies of documents confirming the fact of investment in the investment project within the last thirty-six (36) months prior to the date of application (primary accounting documents executed in accordance with the Law of the Republic of Kazakhstan «On Accounting and Financial Reporting»;

invoices issued in accordance with the Code of the Republic of Kazakhstan «On Taxes and Other Mandatory Payments to the Budget (Tax Code)»;

customs declarations issued in accordance with the Code of the Republic of Kazakhstan «On Customs Regulation in the Republic of Kazakhstan»).

  • Who can issue an invitation for a foreign citizen?

A visa is issued on the basis of an invitation from the receiving party (Ed: a Kazakhstani company). The inviting party may be JSC «NC «KAZAKH INVEST» or the Investment Committee of the Ministry of Foreign Affairs of the Republic of Kazakhstan.

  • What investment options in the economy of Kazakhstan are available, and what supporting documents must be provided?

3.1. Purchase of real estate with the provision of a preliminary purchase and sale agreement (ПДКП) in accordance with Article 390 of the Civil Code of the Republic of Kazakhstan. Why a preliminary agreement? Under the legislation of the Republic of Kazakhstan, foreign citizens are not allowed to acquire real estate without obtaining a specific status. Therefore, a preliminary purchase and sale agreement is concluded, and only after obtaining an investor visa may the main purchase and sale agreement be executed.

3.2 Investment in the charter capital of an operating company. Supporting documents:

  • Payment order / bank receipt confirming the transfer of funds to the company’s bank account. The payment purpose must indicate: «Contribution to the charter capital of LLP “_____” from (full name / company name)» (rus: «Взнос в уставный капитал ТОО “_____” от (ФИО / компании)»).
  • A statement from the company’s bank account showing the receipt of funds.
  • Decision of the founder (or minutes of the general meeting) on making the contribution.
  • Accounting certificate (internal document) confirming the crediting of funds to the charter capital.
