Registration of a temporary residence permit (TRP) for the purpose of employment for citizens of the Russian Federation
In order for citizens of EAEU and CIS member states to stay in the Republic of Kazakhstan longer than the visa-free period, they will need to obtain a temporary residence permit (TPR).
In order to obtain a temporary residence permit, a foreigner needs to justify the purpose of his/her stay in Kazakhstan. These can be the following purposes:
- work, medical treatment, study;
- reunification with family;
- business immigrant (to carry out entrepreneurial activities);
- missionary activity.
If the purpose of arrival is work, it is necessary first be employed in order to apply for a temporary residence permit.
A citizen of the Russian Federation came to us to apply for a temporary residence permit for the purpose of employment. During the process it turned out that he had a valid temporary residence permit from another company.
If the foreigner had applied for a new temporary residence permit without cancelling the current one (if the remaining period is more than a month), he would have received a refusal for the reason: «There is a valid residence permit».
What should be done in this situation?
It is necessary to cancel the valid temporary residence permit from the previous employer. Upon cancellation of the temporary residence permit, the Migration Service Department issues a cancelled/reduced temporary residence permit with a new term. Before the expiry of the shortened temporary residence permit, it is necessary to apply for a new one.
If the old company is unable to cancel the new temporary residence permit for any reason, it is necessary to attach the Order on termination of the employment contract with this company when applying for a new temporary residence permit.
List of documents to apply for a temporary residence permit if you already have a valid temporary residence permit from another company:
- Passport of the foreign employee;
- Labour contract (registered in the unified system of registration of labour contracts «ULARS» or civil law contract on performance of works);
- Order on cancellation of the employment contract with the old company/cancelled abbreviated temporary residence permit;
- Notarised consent from the landlord;
- Letter of application from the company;
- Application form (in some Public Service Centers the employees fill it in online themselves);
- Dactyloscopy certificate (information below).
On December 23, 2023 the Head of State signed the Law «On introducing amendments and additions to some legislative acts of the Republic of Kazakhstan on the issues of the state corporation «Government for Citizens», international technological park «Astana Hub» and fingerprint registration».
In accordance with Article 10 of the Law, from January 1, 2024 the following persons who have reached the age of sixteen are subject to compulsory dactyloscopic registration:
- citizens of the Republic of Kazakhstan, foreigners and stateless persons in respect of whom a decision has been made to issue a seaman’s identity card of the Republic of Kazakhstan;
- foreigners and stateless persons when obtaining a temporary or permanent residence permit in the Republic of Kazakhstan.
To undergo dactyloscopic registration, foreigners and stateless persons should apply to the territorial police authorities at the place of their stay. At the same time, we inform that refusal to undergo compulsory dactyloscopic registration entails administrative expulsion from the Republic of Kazakhstan in accordance with part 2 of article 443-1 of the Code of Administrative Offences of the Republic of Kazakhstan.
What else do you need to know?
- The temporary residence permit is issued for 1 year, but if the period of validity of the foreign labor passport is less than this period, the temporary residence permit is issued for the period of validity of the passport.
- The term of the labour contract affects the term of the temporary residence permit. For what period of time the labour contract is concluded, for the same period of time the temporary residence permit will be issued, but not longer than 1 year.
- The period of consent from the landlord also affects the term of the temporary residence permit.
The temporary residence permit can be applied for through:
- the state corporation «Government for Citizens» at the place of company registration;
- web portal https://egov.kz/cms/ru (e-government of the RoK), using EDS keys of the company.
How many days does this process take?
From the day of submission of documents to the Government Corporation and/or through the portal – 1 working day. It should be taken into account that sometimes technical failures or errors may occur.
Important: Documents that are drawn up in a foreign language must be translated into the state or Russian language.
