Temporary residence permit for business immigrants for citizens of the Kyrgyz Republic in Kazakhstan

A temporary residence permit (TRP) for business immigrants is a document that must be obtained by those wishing to open or acquire a business in Kazakhstan. Such a TRP is issued on the basis of entrepreneurial activity and is valid for 90 days, with the possibility of further extension for one year, but this will only be possible after registering the business.

Who is eligible for a business immigrant residence permit?

  • To open a company in Kazakhstan
  • To acquire a stake in an already registered legal entity
  • To carry out entrepreneurial activities

A citizen of the Kyrgyz Republic contacted us with a request to help him obtain a temporary residence permit for business immigrants. He wanted to open a limited liability company in Kazakhstan. We sent him a list of documents and asked him not to come to Kazakhstan yet and to first prepare the documents that were required from his country of citizenship.

List of required documents:

To obtain a temporary residence permit for business immigration, citizens of the Kyrgyz Republic must prepare the following documents:

  1. Passport for which the temporary residence permit is being issued. Important: the last entry into Kazakhstan must have been made using this passport.
  2. ID card of the Kyrgyz Republic. In some areas of the Public Service Center, an ID card is required even when applying for a temporary residence permit on a foreign passport.
  3. The individual identification number must be issued for the same passport used to enter Kazakhstan.
  4. Certificate of no criminal record from the country of citizenship. Valid for 180 days. If not in Russian, a notarized translation is required.
  5. Medical certificate form 028/u.
  6. Certificate of fingerprinting.
  7. VMS (mandatory medical insurance) contract.
  • Must cover the entire period of the requested temporary residence permit.
  • Passport details in the contract must match the documents.
  • If there is a QR code, an electronic version is permitted (it will simply need to be printed out before submission).
  1. Certificate of no restrictions on entrepreneurial activity.
  2. This certificate is not issued to citizens of the Kyrgyz Republic. Instead, a certificate from the tax office confirming that there are no outstanding debts, with a live stamp (and a notarized translation if necessary), is provided.
  3. Notification of last arrival.
  4. Notarized consent of the property owner. The term of consent must cover the term of the requested TRP.

Since the business immigrant’s temporary residence permit is issued in the name of the property owner at the address of their registration, it is necessary to agree with them in advance on the submission or obtain a power of attorney from the owner.

We accompanied the process even before the foreigner arrived in Kazakhstan:

The foreigner obtained certificates in their country of citizenship and sent us scanned copies of the documents. We checked them and advised where corrections were needed.  We also warned that entry into Kazakhstan must be with a foreign passport if a temporary residence permit is being issued for it.

After arriving in Kazakhstan, we:

  1. helped with the IIN registration process.
  2. accompanied them to fingerprinting.
  3. arranged for them to obtain medical certificates.

The owner of the apartment was unable to be present when the documents were submitted, so we obtained a notarized power of attorney from him. After gathering all the documents, we contacted the Public Service Center at the owner’s place of registration. We submitted the application, and the next day the temporary residence permit was issued.

Terms and obligations after receiving a temporary residence permit

A temporary residence permit is issued for 90 days.

During these 90 days, it is mandatory to:

  • open a limited liability company or
  • acquire a share in an existing company

A temporary residence permit for a business immigrant is not reissued — it can only be extended for 1 year, and only if the business is operating.
