The procedure of work permit extension for Ukrainian citizens in average takes one month. Due to the termination of the foreign specialist, a citizen of Azerbaijan, the employer decided to replace the specialist by the current work permit for a citizen of Ukraine.

According to the Rules, as well as the Authorities’ practical requirements, for the possibility of work permit replacement for a new specialist, it was necessary to provide the documents confirming the retirement of the previous specialist, especially the order on termination of the employment contract, canceled and exit visas, tickets to the country of residence. Since Azerbaijani citizens do not need a visa to stay in the Republic of Kazakhstan, for the replacement process were provided the exit stamps in the passport instead of the visas, as confirmation of his departure from the Republic of Kazakhstan, and as a result, the work permit was successfully reissued for a citizen of Ukraine.

Procedure usually takes 10-12 business days. Dependents (spouse and children under 18 years old) may also get the same type of visa without right to work.

 The citizens of visa-free countries have the opportunity to apply for a work visa in the Republic of Kazakhstan after arriving in the country. In this case, the documents should be submitted not later than 5 business days before the expiration of the visa-free staying period. This option is a great opportunity for foreign specialists, as they can apply for visas for themselves and family members simultaneously commencing his job duties.  However, it should be noted that the passports of foreign citizens will be held by the Authorities for over 10 business days, respectively, they will not be able to travel to other regions of the Republic of Kazakhstan.

Work visa is usually issued for 1 year. A month prior to the expiration date work visa renewal process can be started. Work visa renewal application should be submitted not later than 5 business days prior to the expiration date. Otherwise foreign resident should leave the country and apply for visa in the country of permanent residence abroad.  Original passport will be required for the prolongation process. During the process (5-12 business days) foreign resident should stay in country without original passport and without the right to leave the city of application.

There are several most popular types of business visas: B1, B2, B3. It depends on period and purpose of visit to choose correct category of visa. Visa is issued on the basis of a Letter of Invitation from the employer in Kazakhstan. Letter of Invitation should be officially approved by the Authority in Kazakhstan. Business visa cannot be issued for dependent family members. Work activities are strictly prohibited under any type of business visa. Foreign residents cannot sign Labour contract or get salary in Kazakhstan from the Inviting entity.

Russian citizens may stay in Kazakhstan without registration for 30 calendar days. Passport registration is carried out for a period of up to 90 calendar days for private and business purposes or for the duration of the employment contract.

Citizens of Ukraine are not required to register a passport within 90 calendar days within a 180-day period of stay according to the Agreement between Ukraine and the Republic of Kazakhstan. However, this Agreement does not cancel the mandatory notification of arrival, which should be submitted to the Migration Authority within 3 business days from the date of crossing the border of the Republic of Kazakhstan.

Passport registration is not required for Korean citizens according to the Agreement on mutual trips concluded between the Republic of Kazakhstan and the Republic of Korea. Korean citizens may stay in the Republic of Kazakhstan without a visa for up to 30 days, while the stay should not exceed 60 calendar days in total for each 180-day period.

Passport registration is not required for Indian citizens, as they need a visa to enter the territory of the Republic of Kazakhstan. Upon arrival in the country, it is mandatory to notify the Migration Authorities within 3 business days.

Azerbaijani citizens should complete the passport registration within 5 calendar days since arrival in Kazakhstan. At the same time, the period of stay of an Azerbaijani citizen should not exceed 30 calendar days on private and business visits. Long-term stay is possible up to 1 year for a work purpose with a work permit.

Citizens of Serbia should complete passport registration within 5 calendar days since arrival in Kazakhstan. At the same time, the period of visa-free stay of citizens of Serbia should not exceed 30 calendar days. Long staying period is possible with business and work visas.

Citizens of Uzbekistan should complete passport registration within 5 calendar days since arrival in Kazakhstan. At the same time, the period of stay of a citizen of Uzbekistan should not exceed 30 calendar days for private and business visits. Long-term staying is possible up to 1 year based on the work permit.

Based on the Agreement between Ukraine and the Republic of Kazakhstan, citizens of Ukraine may stay in Kazakhstan without a visa and registration up to 90 calendar days within 180 calendar days period. However, this Agreement does not preclude the obligatory submission of notifications of arrival, which foreign nationals usually forget.

Under terms of agreement of the Eurasian Union, citizens of the Russian Federation are allowed to stay in Kazakhstan for up to 30 days without registration. Nevertheless, the inviting party, in accordance with the legislation of the Republic of Kazakhstan, must notify the Migration Authorities about Russian citizen’s arrival within 3 business days from the date of entry into Kazakhstan.

Under terms of agreement of the Eurasian Union, citizens of the Kirgizia are allowed to stay in Kazakhstan for up to 30 days without registration. Nevertheless, the inviting party, in accordance with the legislation of the Republic of Kazakhstan, must notify the Migration Authorities about Kirgiz resident’s arrival within 3 business days from the date of entry into Kazakhstan.

Under terms of agreement of the Eurasian Union, citizens of the Kyrgyzstan are allowed to stay in Kazakhstan for up to 30 days without registration. Nevertheless, the inviting party, in accordance with the legislation of the Republic of Kazakhstan, must notify the Migration Authorities about Kyrgyz resident’s arrival within 3 business days from the date of entry into Kazakhstan.

US citizens can enter Kazakhstan under a visa-free regime for up to 30 calendar days. At the same time, the inviting party (individual or legal entity) is also obliged to submit a notification of arrival within 3 business days from the date of entry.

Azerbaijani citizens may arrive in Kazakhstan without a visa and stay in the country based on the registration. If the duration of stay does not exceed 5 days, registration is not required. Nevertheless, upon arrival of Azerbaijani citizens in Kazakhstan, the inviting party (individual or company) in accordance with the legislation of the Republic of Kazakhstan must submit a notification within 3 business days from the date of entry into Kazakhstan. Further registration does not preclude the requirement to file a notification of arrival.

Serbian citizens may enter Kazakhstan by visa and under a visa-free regime for up to 30 calendar days. At the same time, the inviting party (individual or legal entity) is also obliged to submit a notification of arrival within 3 business days from the date of entry.

Citizens of Uzbekistan may arrive in Kazakhstan without a visa and stay in the country based on the registration. If the duration of stay does not exceed 5 days, registration is not required. Nevertheless, upon arrival of Uzbek citizens in Kazakhstan, the inviting party (individual or company) in accordance with the legislation of the Republic of Kazakhstan, must submit a notification within 3 business days from the date of entry into Kazakhstan. Further registration does not preclude the requirement to file a notification of arrival.

Recently, the Authorized bodies in the Republic of China have appeared a requirement for the required degree of education (bachelor’s, master’s, doctoral) in Kazakhstani diplomas. Basically, the requirement concerned the customers who apply for work visas to China.

What should citizens do who do not have this information in the diploma? In this case, the Ministry of Education and Science (MES) of the Republic of Kazakhstan processes a written application from citizens and issues an official letter confirming the degree of education.

We issued a power of attorney from the client, after which we submitted an application to the Ministry of Education and Science of the Republic of Kazakhstan, attaching a notarized copy of the client’s diploma and passport, a copy of the university’s archive certificate (if available), as well as a notarized copy of the power of attorney and a copy of the authorized person’s identity card. Processing this request takes at least 1 month, after which a confirmation letter can then be legalized for use in the Republic of China through the Department of the Consular Service of the Ministry of Foreign Affairs of the Republic of Kazakhstan and the Consulate of the Republic of China in the Republic of Kazakhstan.

Foreign citizens after completion of work in the Republic of Kazakhstan often require a certificate of criminal record on the territory of the Republic of Kazakhstan.

This certificate is issued by the General Prosecutor’s Office of the Republic of Kazakhstan and must be apostilled / legalized, depending on the country of departure of the foreign specialist.

Registration of a criminal record and its apostillization takes approximately 5-8 business days.

Since May 2019, the Philippines has officially replaced the process of legalization of documents with the process of putting apostille, ratifying the Hague Convention of 1961 in September 2018. Now all documents issued in the Philippines need to be apostilled. In our practice, there was the opposite case of document apostilization in Kazakhstan for the Philippine government agencies. As it turned out, even Philippine citizens have Kazakhstani visa for the official employment in Kazakhstan, they cannot leave their country without registering an Employment Agreement with an apostille from Kazakhstan at local employment agencies. Our team has successful experience with completing several such cases.

A Lithuanian citizen needed a nostrification of a diploma for the work permit obtainment and employment in a pharmaceutical company in Kazakhstan, since it was received by a medical specialty.

For the nostrification process, a complete package of documents was collected and submitted to the Authorized Body. The process took about 4 months, after which the medical diploma of the foreign specialist was set equal to the degree of “General Practitioner” according to the local Kazakhstani medical educational system. The nostrification certificate was further attached to the package of documents for obtainment of the work permit for the foreign specialist in the local pharmaceutical company.
